• You are at least 18 years of age, or are using the Services under the supervision of a parent or legal guardian;
• You have the authority to bind any organization or team on whose behalf you are placing an order or setting up a store;
• All information you provide is accurate, current, and complete.

All orders are subject to acceptance by Breakaway Sports. We reserve the right to refuse or cancel any order at any time for reasons including but not limited to product availability, pricing errors, or concerns about the order itself. You will be notified promptly in such cases.

The majority of our products are custom-made to your specifications. By submitting an order with custom details (team name, colors, numbers, logos, artwork), you represent that:

• You have the right to use all logos, artwork, and design elements submitted;
• The content does not infringe on any third-party intellectual property, trademark, or copyright;
• You authorize Breakaway Sports to reproduce the submitted artwork solely for fulfillment of your order.

Breakaway Sports is not liable for errors in custom orders that result from incorrect information, artwork, or specifications provided by the customer. Please review all order confirmations and proofs carefully before approval.

Due to the custom nature of our products, order changes or cancellations may not be possible once production has begun. Please contact us as soon as possible at info@breakawaysports.net or 1-973-845-2910 if you need to modify an order. We will do our best to accommodate changes but cannot guarantee them once the production process has started.

When applicable, artwork proofs will be provided for customer review and approval prior to production. By approving a proof, you accept full responsibility for the accuracy of the design, including spelling, numbers, colors, and layout. Breakaway Sports will not be liable for errors approved by the customer.

All prices are quoted in U.S. dollars. Quoted prices are valid for the duration specified in the quote or, if not specified, for thirty (30) days from the date of issuance. Breakaway Sports reserves the right to update pricing at any time. Prices do not include applicable taxes or shipping unless explicitly stated.

Payment is due in accordance with the terms stated on your invoice or order confirmation. We accept payment via the methods specified at checkout or in your quote. All payments are processed securely. We do not store full payment card numbers.

Accounts with overdue balances may be subject to late fees or suspension of services until the balance is resolved. Breakaway Sports reserves the right to pursue collection of unpaid balances.

Breakaway Sports offers free online team stores to qualifying teams and organizations. The following terms apply to team store setup and operation:

• The team administrator is responsible for ensuring the accuracy of products, pricing, and closing dates communicated to their team or community;
• Team stores may have a specified open/close window; orders placed after the closing date may not be accommodated;
• Breakaway Sports is not responsible for individual team members’ failure to submit orders within the designated timeframe;
• Direct-to-player shipping, where offered, requires accurate shipping addresses provided by the team administrator or individual purchasers. Breakaway Sports is not liable for delivery failures due to incorrect address information;
• Breakaway Sports reserves the right to close, modify, or discontinue a team store at any time, with reasonable notice to the team administrator.

Shipping timelines are estimates only and are not guaranteed. Factors outside our control — including carrier delays, weather events, or supply chain disruptions — may affect delivery schedules. Breakaway Sports will communicate expected timelines at the time of order and will provide updates if significant delays arise.

Risk of loss and title for products pass to the customer upon delivery to the carrier. If you receive a shipment that appears damaged or incomplete, please contact us within five (5) business days of receipt.

Because our products are custom-manufactured to individual specifications, we generally cannot accept returns or exchanges except in cases where:

• The product is materially defective or damaged upon receipt;
• The product differs materially from the approved proof or order confirmation.

If you believe your order contains a defect or error on our part, please contact us at info@breakawaysports.net within ten (10) business days of receipt and include your order number, a description of the issue, and supporting photos. We will work with you to resolve the issue promptly, which may include replacement, credit, or other remedies at our discretion.

Courtesy fill-in and late add-on orders are accommodated where possible and are subject to our standard production and shipping timelines. Additional fees may apply.

All content on the Breakaway Sports website — including text, graphics, logos, images, and software — is the property of Breakaway Sports or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without prior written permission from Breakaway Sports.

Customer-submitted artwork and logos remain the property of the submitting party. By submitting artwork, you grant Breakaway Sports a limited, non-exclusive license to use the artwork solely for the purpose of fulfilling your order.

You can control cookies through your browser settings. Disabling certain cookies may affect the functionality of our website or team stores. We honor applicable opt-out mechanisms for interest-based advertising.

To the fullest extent permitted by applicable law, Breakaway Sports shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services, even if advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or your use of our Services shall not exceed the total amount paid by you for the specific order giving rise to the claim.

Our Services are provided on an “as is” and “as available” basis. Breakaway Sports makes no warranties, express or implied, regarding the Services, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components.

You agree to indemnify, defend, and hold harmless Breakaway Sports and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses — including reasonable legal fees — arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) any artwork, content, or information you submit; or (d) your violation of any third-party rights.

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New Jersey.

Breakaway Sports reserves the right to update or modify these Terms at any time. When we do, we will update the “Last Updated” date at the top of this page. Your continued use of our Services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
